By accessing, browsing, or using the website TuroReports.com (hereinafter referred to as the "Service," "Platform," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service.
These Terms constitute a legally binding agreement between you and TuroReports.com. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any such change constitutes your agreement to follow and be bound by the Terms as changed.
TuroReports.com is an independent third-party software utility designed to assist vehicle hosts and fleet managers in parsing, organizing, and calculating financial data from CSV exports.
2.1 No Affiliation or Relationship with Turo Inc.: You expressly acknowledge and agree that TuroReports.com is a completely independent entity. We are NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with Turo Inc., or any of its subsidiaries or its affiliates. The name "Turo" as well as related names, marks, emblems, and images are registered trademarks of their respective owners.
2.2 No Agency or Partnership: You agree that no joint venture, partnership, employment, franchise, or agency relationship exists between TuroReports.com and Turo Inc. as a result of these Terms or your use of the Service. TuroReports.com does not operate under the authority of Turo Inc. and has no authority to bind Turo Inc. to any agreement or representation.
2.3 Service "As Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Service or the information, content, materials, or products included on the Service.
3.1 Paid Subscriptions: Certain features of the Service are only available through a paid subscription ("Subscription"). By selecting a Subscription, you agree to pay TuroReports.com the monthly or annual subscription fees indicated for that service. Payments will be charged on the day you sign up for a Subscription and will cover the use of that service for a monthly or annual period as indicated. All payment processing is handled securely by Stripe, Inc., a PCI-compliant third-party payment processor. TuroReports.com does not store your credit card information on its servers.
3.2 Automatic Renewal: UNLESS YOU NOTIFY US BEFORE THE END OF THE APPLICABLE SUBSCRIPTION PERIOD THAT YOU WANT TO CANCEL A SUBSCRIPTION, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US TO COLLECT THE THEN-APPLICABLE ANNUAL OR MONTHLY SUBSCRIPTION FEE USING ANY CREDIT CARD OR OTHER PAYMENT MECHANISM WE HAVE ON RECORD FOR YOU.
3.3 Cancellation: You may cancel your Subscription at any time through your account settings. Cancellation will take effect at the end of the current paid period. You will continue to have access to the Service through the end of your current billing period.
3.4 Price Changes: We reserve the right to adjust pricing for our Service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes to your service will take effect following email notice to you.
4.1 All Sales Final: EXCEPT AS EXPRESSLY PROVIDED IN SECTION 4.2 BELOW, ALL PAYMENTS ARE NON-REFUNDABLE AND ALL SALES ARE FINAL. THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS.
4.2 30-Day Money-Back Guarantee: We offer a one-time 30-Day Money-Back Guarantee for new subscribers only. If you are not satisfied with the Service, you may request a refund within thirty (30) calendar days of your initial purchase date.
4.3 Refund Discretion and Eligibility: (a) To request a refund, you must contact support within the 30-day window. (b) This guarantee applies only to your first Subscription. Renewal payments are not eligible for this guarantee. (c) TuroReports.com reserves the right to deny a refund request if we detect abuse of this policy, including but not limited to: creating multiple accounts to utilize the guarantee repeatedly, utilizing the Service to parse a high volume of data and then requesting a refund, or any other form of fraudulent activity.
5.1 Program Participation: TuroReports.com may, from time to time, offer a referral program ("Referral Program") allowing users to earn credits, commissions, or rewards by referring new customers to the Service. Participation in the Referral Program is voluntary and subject to your strict compliance with these Terms.
5.2 Eligibility Determination: TuroReports.com reserves the sole and absolute right to determine the eligibility of any user to participate in the Referral Program and the validity of any referral. We may disqualify any user or referral at any time for any reason or no reason at all.
5.3 No Income Guarantees: YOU ACKNOWLEDGE AND AGREE THAT TUROREPORTS.COM MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE AMOUNT OF INCOME, COMMISSIONS, OR CREDITS YOU MAY EARN THROUGH THE REFERRAL PROGRAM. Any examples of earnings provided by us are for illustrative purposes only and are not a guarantee of future performance.
5.4 Qualified Referrals and Verification: (a) A "Qualified Referral" occurs only when a new user (i) arrives at our Service via your unique link, (ii) creates a new account, and (iii) completes a bona fide purchase of a Subscription that is not subsequently refunded, charged back, or disputed. (b) All referrals are subject to a verification period determined by us. We reserve the right to withhold or delay payment of rewards while we investigate the validity of the referral.
5.5 Right to Reject and Revoke: We reserve the right to reject any referral or revoke any rewards if we suspect, in our sole discretion, that the referral: (a) Was generated via self-referral, fake accounts, or "bot" traffic; (b) Resulted from spamming, unsolicited email, or posting on "coupon" or "deal" sites; (c) Was generated by bidding on TuroReports.com keywords in paid search/social advertising; (d) Is associated with a user who violates these Terms.
5.6 Program Modification or Termination: TuroReports.com reserves the right to modify, suspend, or terminate the Referral Program, or change the reward structure, at any time without prior notice. In the event of program termination, TuroReports.com shall have no liability to pay out any accrued but unpaid rewards that do not meet the criteria for payment at the time of termination.
5.7 Independent Contractor: Your participation in the Referral Program does not create an employment, agency, franchise, or partnership relationship between you and TuroReports.com. You are solely responsible for reporting and paying any applicable taxes on rewards received.
6.1 User as Final Auditor: You acknowledge and agree that TuroReports.com is an automated calculation tool subject to software limitations, parsing errors, and unexpected formatting changes in source files. You are solely and strictly responsible for verifying the accuracy, completeness, and reliability of any report, statement, or calculation generated by the Service.
6.2 No Professional Advice: The content and reports generated by this Service are for informational purposes only and do not constitute legal, tax, accounting, or professional financial advice. You should verify all figures with a qualified Certified Public Accountant (CPA) or tax professional before using them for tax filings, business transactions, or disbursements to vehicle owners.
6.3 Release of Liability: Under no circumstances shall TuroReports.com be liable for any overpayments, underpayments, tax penalties, audits, loss of revenue, strained business relationships, or legal disputes resulting from inaccuracies, omissions, or errors in the reports generated by our Service.
7.1 Your Data: You retain all ownership rights to the raw CSV or Excel files you upload to the Service ("User Content").
7.2 License to Us: By uploading User Content, you hereby grant TuroReports.com a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and TuroReports.com's (and its successors' and affiliates') business.
7.3 Internal Usage: Specifically, you grant us the right to store, parse, analyze, and retain your User Content to: (a) Generate the requested reports; (b) Train and improve our parsing algorithms; (c) Conduct internal quality assurance and bug testing; (d) Analyze usage trends to improve the Service.
You agree not to use the Service to: (a) Upload content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware; (b) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service; (c) Use the Service for any unlawful purpose or in violation of any local, state, national, or international law; (d) Attempt to gain unauthorized access to the Service, user accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.
9.1 Transactional Emails: By creating an account, you consent to receive transactional emails from TuroReports.com, including but not limited to: account verification, password reset, subscription confirmations, payment receipts, report delivery notifications, and system alerts. These communications are essential to the operation of the Service and cannot be opted out of while maintaining an active account.
9.2 Email Delivery: Emails are sent via third-party email service providers (currently Mailgun). We are not responsible for email delivery failures caused by your email provider's spam filters, inbox rules, or server issues.
10.1 Credentials: You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to immediately notify TuroReports.com of any unauthorized use of your account.
10.2 Account Termination: We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. We are not liable to you or any third party for any termination of your access to the Service.
You agree to defend, indemnify, and hold harmless TuroReports.com, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right; or (iv) any claim that your User Content caused damage to a third party.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUROREPORTS.COM BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in the State of Florida before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.
YOU AND TUROREPORTS.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15.1 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
15.2 Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control.
15.3 Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings and agreements.
15.4 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
